Welcome to Maestro HVACR ("App" or "Service"), a mobile and web-based HVAC training and certification preparation application operated by ACVOLT Tech School Inc. ("Company," "we," "us," or "our"), located in San Bernardino, California, United States.

By accessing, downloading, installing, or using our App, you ("User," "Student," "Technician," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

⚠️ IMPORTANT: By clicking "I Agree" or using this App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations of the State of California and the United States.

2. Description of Service

Maestro HVACR is an educational application designed for HVAC, refrigeration, and electrical technicians. The App provides:

Interactive quizzes and certification exam preparation (EPA 608, NATE, OSHA 30, ESCO)
Study materials organized by skill levels (Principiante, Intermedio, Avanzado, Elite, Platino)
Progress tracking and performance analytics
Digital certificates of completion
Attendance tracking for enrolled students
Access to educational video content

📚 Educational Purpose: This App is designed as a supplementary study tool. Completion of levels or quizzes does NOT constitute official certification. Official certifications must be obtained through accredited testing organizations (EPA, NATE, OSHA, etc.).

3. Eligibility

To use Maestro HVACR, you must:

Be at least 18 years of age
Be a current or prospective HVAC/R technician or student
Provide accurate and complete registration information
Have a valid email address for account verification
Comply with all applicable federal, state, and local laws
Accept these Terms of Service and Privacy Policy

4. Account Registration and Security

4.1 Account Creation

To access the full features of the App, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your information as needed
Keep your password confidential and secure
Not share your account credentials with others
Notify us immediately of any unauthorized access to your account
Accept full responsibility for all activities under your account

4.2 One-Time Password (OTP) / Magic Link

When requesting access via OTP or Magic Link, you acknowledge and agree to these Terms of Service before receiving access credentials.

5. Purchase and Pricing

5.1 One-Time Purchase

Maestro HVACR is offered as a one-time purchase through the Apple App Store and Google Play Store. There are no subscriptions, no automatic renewals, and no recurring charges.

There are no locked tiers, no paywalls inside the app, and no upsells after purchase.

5.2 What Is Not Included

The following services are offered separately by ACVOLT Tech School and are not part of the app purchase:

Live classes or private tutoring
Official in-person training at ACVOLT Tech School
Official EPA, NATE, OSHA, or ESCO certifications (issued by accredited testing organizations)

5.3 Payment Processing

All purchases are processed by Apple (App Store) or Google (Play Store)
Prices are set by the stores and may vary slightly by local currency and tax
We do not receive or store your payment card information

6. Refunds

Because Maestro HVACR is sold exclusively through Apple and Google, all refund requests are handled directly by the platform where you made the purchase:

Eligibility and timing follow each store's standard refund policy. We do not process refunds directly.

8. Acceptable Use Policy

8.1 Permitted Use

You may use the App for:

Personal educational purposes
Studying for HVAC/R certification exams
Tracking your learning progress

8.2 Prohibited Activities

You agree NOT to:

Share, distribute, or sell quiz questions or answers
Take screenshots or record content from the App
Share your account credentials with others
Attempt to bypass store protections or re-distribute the purchased app
Use automated tools to access or extract content
Reverse engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Interfere with the App's security or functionality

🚫 Screenshot Protection: This App includes screenshot detection and prevention technology. Attempting to capture screenshots may result in content being blocked and potential account suspension.

9. Study Time Limits

For your health and optimal learning:

The App enforces a 1-hour continuous study limit
After 1 hour, a mandatory 1-hour break is required
This promotes healthy study habits and better information retention

10. Intellectual Property

All content within Maestro HVACR, including but not limited to:

Quiz questions and answers
Study materials and explanations
Software code and design
Logos, trademarks, and branding
Video and audio content

Is the exclusive property of ACVOLT Tech School Inc. and is protected by U.S. and international copyright, trademark, and intellectual property laws.

11. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the App, you consent to:

Collection of account information (name, email, phone)
Tracking of study progress and quiz performance
Attendance monitoring for enrolled students
Device information for security purposes

11.1 California Consumer Privacy Act (CCPA)

California residents have additional rights under the CCPA, including:

Right to know what personal information is collected
Right to delete personal information
Right to opt-out of sale of personal information (we do not sell your data)
Right to non-discrimination for exercising privacy rights

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

THIS APP IS AN EDUCATIONAL TOOL AND DOES NOT GUARANTEE PASSING ANY CERTIFICATION EXAM. SUCCESS DEPENDS ON INDIVIDUAL EFFORT AND STUDY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW:

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
We are not liable for indirect, incidental, special, or consequential damages
We are not responsible for exam results or certification outcomes

14. Indemnification

You agree to indemnify and hold harmless ACVOLT Tech School Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in San Bernardino County, California, conducted by a single arbitrator under the rules of the American Arbitration Association.

15.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

15.4 Small Claims Exception

Either party may bring an individual action in small claims court in San Bernardino County, California.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted within the App and on our website. Continued use after changes constitutes acceptance of the modified Terms.

17. Termination

We may suspend or terminate your account if you:

Violate these Terms of Service
Engage in fraudulent activity
Share account credentials or content
Attempt to bypass the one-time purchase or redistribute the app

You are at least 18 years of age
You understand the app is sold as a one-time purchase ($59.99 USD in the United States / $29.99 USD in Latin America) through Apple or Google
You understand the one-time purchase unlocks all in-app features permanently — there are no subscriptions, no renewals, and no paywalls after purchase
You understand that all refund requests are handled by the platform of purchase (Apple or Google) under that platform's standard refund policy
You consent to our Privacy Policy

3. Elegibilidad

Para usar Maestro HVACR, usted debe:

Tener al menos 18 años de edad
Ser un técnico HVAC/R actual o aspirante, o estudiante
Proporcionar información de registro precisa y completa
Tener una dirección de correo electrónico válida para verificación de cuenta
Cumplir con todas las leyes federales, estatales y locales aplicables
Aceptar estos Términos de Servicio y Política de Privacidad

4. Registro de Cuenta y Seguridad

4.1 Creación de Cuenta

Para acceder a todas las funciones de la App, debe crear una cuenta. Usted acepta:

Proporcionar información precisa, actual y completa durante el registro
Mantener y actualizar su información según sea necesario
Mantener su contraseña confidencial y segura
No compartir las credenciales de su cuenta con otros

Maestro HVACR se ofrece como una compra única a través de la Apple App Store y Google Play Store. No hay suscripciones, renovaciones automáticas ni cargos recurrentes.

5.2 Lo que No Está Incluido

Los siguientes servicios los ofrece ACVOLT Tech School por separado y no forman parte de la compra de la app:

Clases en vivo o tutorías privadas
Entrenamiento presencial en ACVOLT Tech School
Certificaciones oficiales de EPA, NATE, OSHA o ESCO (emitidas por organizaciones de pruebas acreditadas)

5.3 Procesamiento de Pago

Todas las compras se procesan por Apple (App Store) o Google (Play Store)
Los precios los fijan las tiendas y pueden variar ligeramente por moneda local e impuestos
No recibimos ni almacenamos información de su tarjeta de pago

6. Reembolsos

Debido a que Maestro HVACR se vende exclusivamente a través de Apple y Google, todas las solicitudes de reembolso se manejan directamente con la plataforma donde realizó la compra:

Interferir con la seguridad o funcionalidad de la App

🚫 Protección contra Capturas de Pantalla: Esta App incluye tecnología de detección y prevención de capturas de pantalla. Intentar capturar pantallas puede resultar en bloqueo de contenido y posible suspensión de cuenta.

9. Límites de Tiempo de Estudio

Para su salud y aprendizaje óptimo:

La App aplica un límite de estudio continuo de 1 hora
Después de 1 hora, se requiere un descanso obligatorio de 1 hora
Esto promueve hábitos de estudio saludables y mejor retención de información

10. Propiedad Intelectual

Todo el contenido dentro de Maestro HVACR, incluyendo pero no limitado a:

Preguntas y respuestas de cuestionarios
Materiales de estudio y explicaciones
Código de software y diseño
Logotipos, marcas comerciales y marca
Contenido de video y audio

Es propiedad exclusiva de ACVOLT Tech School Inc. y está protegido por leyes de derechos de autor, marcas comerciales y propiedad intelectual de EE.UU. e internacionales.

11. Privacidad y Recopilación de Datos

Su privacidad es importante para nosotros. Nuestra recopilación y uso de información personal se rige por nuestra Política de Privacidad. Al usar la App, usted consiente:

Recopilación de información de cuenta (nombre, email, teléfono)
Seguimiento del progreso de estudio y rendimiento en cuestionarios

13. Limitación de Responsabilidad

14. Indemnización

Usted acepta indemnizar y mantener indemne a ACVOLT Tech School Inc., sus funcionarios, directores, empleados y agentes de cualquier reclamación, daño o gasto que surja de:

Su uso de la App
Su violación de estos Términos
Su violación de derechos de terceros

15. Resolución de Disputas

15.1 Ley Aplicable

Estos Términos se rigen por las leyes del Estado de California, sin consideración a principios de conflicto de leyes.

15.2 Acuerdo de Arbitraje

15.4 Excepción de Reclamos Menores

Podemos suspender o terminar su cuenta si usted:

Participa en actividad fraudulenta
Comparte credenciales de cuenta o contenido
Intenta eludir la compra única o redistribuir la app
